Elon Musk seeks up to $134bn from OpenAI and Microsoft, according to court filings released Friday, claiming entitlement to ‘ill-gotten gains’ generated from his early support of artificial intelligence company.
In lawsuit filed in federal court ahead of hearing in case against two companies, billionaire entrepreneur says OpenAI earned between $65.5bn and $109.4bn due to his contributions after co-founding company in 2015, while Microsoft gained between $13.3bn and $25.1bn.
Lawyers for OpenAI, Microsoft and Musk do not immediately respond to requests for comment outside business hours.
OpenAI describes lawsuit as ‘baseless’ and part of harassment campaign by Musk. Microsoft lawyer says no evidence company ‘aided and abetted’ OpenAI.
Musk, who leaves OpenAI in 2018 and now runs xAI, developer of Grok chatbot, says OpenAI, creator of ChatGPT, violates founding mission through major restructuring to become for-profit entity.
Judge in Oakland, California rules earlier this month that jury will hear case, expected to begin in April.
Court filing says Musk contributes about $38m, around 60% of OpenAI early seed funding, and helps recruit staff, connect founders with key contacts and lend credibility at launch.
Filing adds that ‘ill-gotten gains achieved by OpenAI and Microsoft — which Musk now entitled to recover — far exceed Mr Musk’s initial contributions’.
