Jordan relied on six main points in its argument that it presented before the International Court of Justice on the Israeli occupation, on Thursday, according to the Jordanian representative before the court, the UN expert in international law, British lawyer Michael Wood.
The negotiated solution
The member of the Jordanian legal delegation said that the first point is that any negotiated solution must be achieved on the basis of international law, in accordance with United Nations resolutions in 2004.
The right to self-determination
The second point is the right to self-determination, stressing that the occupation must respect the rights of peoples to determine their own destiny, in accordance with the law of occupation, and the United Nations had called for the establishment of a Palestinian state and the occupation is still half a century behind this continent.
He added that the only way to achieve the right to self-determination is to end this occupation
The establishment of settlements
He considered in the third point that Israel’s policies and practices violate the law of occupation, as it engaged in the establishment of settlements, and 2023 was a record year in the number of settlements that Israel established.
He said that senior Israeli officials have promoted these settlements, in addition to the practices of violence and terrorism that settlers practice against the Palestinian people under the protection of the Israeli police.
Annexation of Palestinian territories
He said that Israel’s practices clearly reflect no room for doubt Israel’s desire to annex the occupied Palestinian territories.
He explained that the basic law of Israel stipulates the annexation of Jerusalem and the continuation of building the separation wall and expanding the settlements and expelling the Palestinians, in addition to the map that the Israeli prime minister presented to the United Nations last September and rejected the two-state solution, which confirms Israel’s intention to annex the Palestinian territories.
Racial segregation
The member of the Jordanian legal delegation confirmed that the discriminatory laws and practices of Israel against the Palestinians are a violation of international law that leads to racial segregation.
He said that Israel is seizing the Palestinian lands in a discriminatory manner, and demolishing their homes and setting military locations, in addition to the continuous military intervention to control the lands by force and shooting.
He explained that Israel has engaged in practices that constitute crimes against humanity in the absence of accountability and accountability for the perpetrators of these crimes.
Stopping the occupation
He considered in the last point that the UN General Assembly asked the court to stop the occupation as something illegal, because the occupation must be temporary, and the occupying authority must not impose its control over the lands, and respect the right of the occupied peoples to achieve their destiny.
He explained that Israel’s serious violations leave no doubt that the occupation in general is illegitimate, but it was for purposes contrary to international law.
The member of the Jordanian legal delegation asked the court for legal consequences arising from these practices, which are:
Israel must end its occupation of all the occupied Palestinian territories, which are the West Bank, East Jerusalem and Gaza.
All countries must stop any assistance to Israel that serves this occupation.
The countries cooperate through the United Nations institutions to investigate, prosecute and punish any individual who violates international law.
