The General Iftaa' Department confirmed that recommending organ donation after death to save patients' lives is permissible under Sharia, as it is considered among acts of righteousness and cooperation in goodness, and in fulfillment of the Sharia's objective of preserving life.
The Department explained, in a fatwa regarding the ruling on bequeathing all organs for donation after death, that donating to avert harm from a patient falls under permissible medical treatment, based on the Almighty's saying: {And whoever saves one, it is as if he had saved all mankind}, and the two legal maxims: "Necessities make the forbidden permissible" and "Necessity is measured by its extent."
It indicated that a person who bequeaths their organs for donation after death concludes their life with a good deed whose reward continues, noting that a patient's need for an organ transplant may exceed a poor person's need for money, and that Sharia urges relieving distress and showing benevolence to people.
The fatwa emphasized that the permissibility of transplanting organs from the deceased is conditional upon Sharia and medical controls, including certain verification of the donor's death, no mutilation of the corpse, physicians deeming the transplant operation likely to succeed, in addition to the existence of a prior will from the donor or the consent of the heirs depending on the type of organ and conditions of transfer.
Regarding donation from living individuals, the fatwa stipulated full legal capacity of the donor, that no harm disrupting their normal life results from it, and that transfer is the best and most likely successful medical option, with a total ban on the sale of organs or receiving any monetary compensation in exchange for them.
The Department called for viewing organ donation as a sublime form of solidarity and benevolence, particularly with medical advancement that has enabled the transplantation of many organs and tissues, saving patients' lives and improving their health conditions.
It is worth noting that the Iftaa' Department previously issued decisions and fatwas permitting organ donation, including the decision on eye cornea donation in 1984, the fatwa on the permissibility of organ donation in 2010, and the decision on donating part of the liver in 2011.
